EmpiresX Ponzi Scheme Litigation

EmpiresX is a web-based platform that was presented to consumers throughout South Florida and South America as an “opportunity to participate in the best experience of investing in a safe and efficient platform,” which purportedly utilized an algorithmic trading bot that utilized artificial intelligence to generate guaranteed returns of 1% per day through its day trading activities in the cryptocurrency and other financial markets. When it was revealed that the EmpiresX platform was in fact a Ponzi Scheme, attorneys Adam M. Moskowitz, Joseph M. Kaye and Barbara C. Lewis filed a class action lawsuit alongside other co-lead counsel to seek compensation for these defrauded investors. A preliminary approval for class action settlement was recently granted.

Florida Universities Campus Fee Litigation

Moskowitz and his team brought suit in state court in Leon County, Florida, in state court seeking a prorated refund of fees paid for campus services students did not receive when the system's dozen institutions shifted to remote learning because of the COVID-19 pandemic. Mortgage Convenience Fee Litigation
Adam M. Moskowitz and Howard M. Bushman, partners at The Moskowitz Law Firm in Coral Gables, have recently secured $12.5 million to settle a nationwide class action against PHH Mortgage Corp. and OCWEN Loan Servicing. The Firm represented homeowners who were subjected to abusive collection practices via “convenience”and “processing” fees. 1 Global Investor Class Action Cases
When 1 Global Capital, a troubled merchant cash advance business, filed for a $300 million bankruptcy in July 2018, the SEC immediately initiated civil enforcement proceedings related to its sale of unregistered securities. The Moskowitz Law Firm and Bonnet, Friedman, Fairbourn & Balint PC, were the first firms in the country to bring multiple class action lawsuits on behalf of 1 Global’s investors against a variety of parties who participated in the company’s illegal sale of unregistered securities. The Firm has successfully settled with over 35 defendants, securing millions of dollars in compensation for these investors.

The Moskowitz Law Firm took an innovative approach in this case, working with counsel for the Debtors and the Creditors’ Committee to assure that investors’ interests were put first in the bankruptcy proceedings. As a consequence of these efforts, the Firm achieved multimillion dollar settlements with many of 1 Global’s brokers, as well as its law firm. Litigation continues, as the Firm pursues additional individuals and entities who may be liable to these investors.
Judge William Thomas, of the Complex Business Division of the Miami-Dade Circuit Court, recently granted preliminary approval for eight proposed settlements between thousands of investors and broker/agents, regarding the purchase of unregistered securities from 1 Global. A final hearing of approval is set before Judge Thomas and the Honorable Robert Mark in federal bankruptcy court. The Moskowitz Firm will continue to coordinate settlements with the Special Counsel for the Bankruptcy Estate. Champlain Towers Surfside Condo Litigation

The Moskowitz Law Firm successfully represented victims of the tragic Champlain Towers building collapse in Surfside, Florida. On June 23, 2022, almost one year to the day after the collapse, Judge Michael Hanzman granted final approval to over $1 billion in settlements intended to pay damages to victims for claims for wrongful death, personal injury, and loss of property. Although our team was saddened by this horrible tragedy, we were honored to represent residents and their families who were impacted, assisting them in submitting claims to the Court for consideration for reimbursement from this historic settlement fund.

Transamerica COI Litigation

Force-Placed (Lender-Placed) Insurance Lawsuits
Adam M. Moskowitz and his team filed the first class action lawsuits challenging the illegal practices of force-placed insurance against Wells Fargo Bank, and were successful in certifying the only litigated class of Florida homeowners with hazard insurance damage. Since that time, Adam has coordinated a coalition of almost 59 different plaintiffs’ law firms from all across the country and successfully brought claims against the largest banks and mortgage services as a result of these coordinated efforts. A few years ago, the Firm’s Founder & Managing Partner Adam Moskowitz decided to publicly share his personal story of addiction and anxiety, as well as his decision to give up alcohol.
Through the support of his family and friends, he was able to overcome his unhealthy lifestyle and reliance on alcohol to cope with stress. He knew he needed to make a change, and realized that these private struggles need a public forum to help and outreach to those that suffer from alcohol, drug, and mental health related issues.
In order to bring about that same change in the lives of others, Adam partnered with the Bolch Judicial Institute of Duke Law School, the University of Miami, and the Dade County Bar Association to organize a National Town Hall on Anxiety, Addiction and Suicide in 2019.
The conference was a resounding success, bringing together top medical experts, judges, and legal practitioners from around the country to discuss and highlight these life-threatening issues, to examine the recommendations of the American Bar Association’s National Task Force on Lawyer Well-Being, and to identify the most promising best practices for the bench and bar.
